Terms of Service

1. Acceptance of Terms

By accessing and using Tabario ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Tabario is a concept-round platform for marketing agencies. One brief becomes six concept routes, each written for LinkedIn and for Instagram, and each route is built into a reviewable timeline you can export as an MP4. The Service creates and edits video content. It does not distribute or publish it.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

4. Credits and Billing

The Service operates on a credit-based system:

• Credits are consumed when generating video ideas and creating videos
• Credit allowances are set by your subscription tier. During the pilot, subscriptions are not open and credits are allocated as part of your pilot agreement
• Unused credits do not expire as long as your account remains active
• Refunds are handled on a case-by-case basis as outlined in our refund policy

5. Content Ownership and License

Your Content: You retain all ownership rights to the content you create using the Service. By using the Service, you grant us a limited license to process, store, and distribute your content as necessary to provide the Service.

AI-Generated Content: Content generated by our AI systems is provided to you under a non-exclusive, worldwide license. You are responsible for ensuring that your use of AI-generated content complies with applicable laws and third-party rights.

6. Publishing and Distribution

Tabario does not publish anything anywhere:

• The Service does not connect to your social media accounts and does not post on your behalf
• We never ask for, receive, or store credentials or access tokens for any social platform
• Export produces an MP4 as a download. Publishing that file is a step you take outside Tabario, and you are responsible for complying with the terms of whichever platform you post it to

7. Video Content Generation Guidelines

Tabario uses AI to generate video content for social media platforms. When using our video generation service, you agree to comply with the following guidelines:

7.1 Prohibited Content

You may not create or generate video content that includes:

• Violence and Harm: Content depicting, promoting, or glorifying violence, self-harm, dangerous activities, or physical harm to individuals or groups
• Hate Speech: Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, disability, disease, age, sexual orientation, gender, or gender identity
• Sexual Content: Explicit sexual content, nudity, sexual services, or content that sexualizes minors in any way
• Illegal Activities: Content promoting illegal drugs, weapons, fraud, human trafficking, or any other illegal activities
• Dangerous Organizations: Content promoting or supporting terrorist organizations, organized crime, or violent extremist groups
• Misinformation: Content containing false information that could cause harm, including health misinformation, election misinformation, or conspiracy theories
• Harassment and Bullying: Content intended to harass, bully, intimidate, or humiliate individuals
• Intellectual Property Infringement: Content that violates copyright, trademark, or other intellectual property rights
• Spam and Manipulation: Content designed to artificially inflate engagement, mislead viewers, or manipulate platform algorithms

7.2 Social Media Platform Compliance

All content generated through Tabario must comply with the community guidelines and terms of service of the platforms where you intend to publish, including but not limited to:

• LinkedIn Professional Community Policies: Content must meet LinkedIn's standards for professional, authentic material
• Instagram Community Guidelines: Content must follow Instagram's standards for appropriate content and behavior
• Platform-Specific Restrictions: You are responsible for understanding and complying with any additional restrictions imposed by social media platforms
• Age-Appropriate Content: Content must be appropriate for the general audience of each platform, respecting age restrictions and content ratings

7.3 Content Moderation and Guardrails

Tabario implements automated content moderation to help ensure compliance with these guidelines:

• Our AI system includes guardrails that may block prompts or content that violate these terms
• Blocked prompts will receive a notification explaining the violation
• Repeated violations may result in account suspension or termination
• We reserve the right to review, remove, or refuse to generate any content at our discretion
• While we employ automated moderation, you remain ultimately responsible for the content you create and publish

7.4 User Responsibility

You acknowledge and agree that:

• You are solely responsible for all content you generate, edit, and publish using Tabario
• You must review all AI-generated content before publishing to ensure compliance with these terms and platform guidelines
• You will face consequences on third-party platforms (including account suspension or removal) if your content violates their policies
• Tabario is not responsible for any actions taken against your accounts by third-party platforms
• You will indemnify Tabario against any claims arising from your use of the Service or content you create

8. Additional Acceptable Use Policies

In addition to the video content guidelines above, you agree not to:

• Distribute malware, viruses, or engage in harmful technical activities
• Attempt to access unauthorized areas of the Service or reverse engineer our systems
• Use the Service to create automated or bot accounts
• Share your account credentials with others or allow unauthorized access
• Scrape, crawl, or systematically extract data from the Service
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Use the Service in any manner that could damage, disable, or impair the Service

9. AI Content Disclaimer

The Service uses artificial intelligence to generate video content, scripts, ideas, and other creative materials. Important disclaimers regarding AI-generated content:

• No Guarantee of Accuracy: AI-generated content may contain errors, inaccuracies, or factually incorrect information
• Review Required: You are solely responsible for reviewing, fact-checking, and editing all AI-generated content before publication
• Quality Variability: We do not guarantee the quality, creativity, appropriateness, or effectiveness of AI-generated content
• Bias and Limitations: AI systems may reflect biases present in training data and have inherent limitations
• Platform Compliance: AI-generated content may not always comply with specific platform requirements without your review and editing
• No Legal Advice: AI-generated content should not be construed as legal, financial, medical, or professional advice
• Originality: While we strive for original content, AI may occasionally generate content similar to existing works

Your Responsibility: By using Tabario's AI features, you acknowledge that you are ultimately responsible for all content you publish and that you will conduct appropriate due diligence before using AI-generated content publicly.

10. Limitation of Liability

To the maximum extent permitted by law, Tabario shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to:

• Loss of revenue or profits
• Loss of data or content
• Loss of business opportunities
• Issues with third-party platforms
• Content generated by the AI system

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
